In view of the affirmed findings of fact resolved after trial on conflicting evidence, and neither version of the transactions being incredible as a matter of law, this court's constitutional scope of review is limited (see NY Const, art VI, § 3, subd a; Cohen and Karger, Powers of the New York Court of Appeals, ch 13). Arguably, indeed, the dissent at the Appellate Division related only to disagreement with the findings of fact and therefore may not have raised a question of law for review in this court.
